TERMS AND CONDITIONS OF MORZINE HOLIDAYS LIMITED


These terms and conditions apply for all booking made on or after 13 Jan 2012.


Previous terms and conditions are available upon request.


A holiday booking is made between Morzine Holidays Ltd (hereafter known as ‘Morzine Holidays’) and the signatory of the booking form who must be over 18 years of age (hereafter known as ‘you’).  The accommodation which consists of Chalet Morin, Chalet Vantaa will hereafter be known as “the chalets”.  All correspondence to Morzine Holidays is to be addressed to: Morzine Holidays Limited, 358 Southbourne Grove, Westcliff-on-sea, Essex SS0 0AQ.  The contract between you and Morzine Holidays is in all circumstances to be governed by these booking conditions.  The number of people in each chalet is strictly limited to those named on the booking form and up to the maximum number stated. For self catered bookings, the chalets are available from 4.00pm on the day of arrival and must be vacated by 10.00am on the day of departure.   For catered bookings, guests are welcome to arrive and depart at any time during the day but bedrooms may not be available until 4.00pm on the day of arrival.

 

Deposits & Confirmation

A deposit of 25% of the holiday cost is payable at the time of booking.  On receipt of your holiday deposit, Morzine Holidays will send you confirmation of booking showing the deposit paid and the balance owing.  Please note on self catered bookings this balance will also include tourist tax, currently payable at 1 euro per day per adult for the 2011/12 season.  A full list of additional services including airport transfers, boot and ski hire, ski school, drinks and restaurant packages, lift passes and childcare will be sent to you upon confirmation of booking.  You will then be able to book all these services directly with Morzine Holidays Limited. The balance due on these additional services will be added to your final invoice.

 

Balance

Full payment of the outstanding balance is due 10 weeks prior to departure. Your final invoice, which includes the balance of the holiday cost and any additional services booked by you, will be sent to you 12 weeks prior to departure.  Payment can be made by credit card by clicking on the link in the invoice which will have been emailed to you.  Credit card payments incur a 2.5% surcharge but payments made by card are not due until 4 weeks before the start date of the holiday.  Payments made by cheque need to arrive 10 weeks prior to the start date of the holiday and should be made payable to Morzine Holidays Ltd  and sent to the registered address  Payments by bank transfer need to be made 10 weeks prior to the start date of the holiday and should have credited our account by that date.  Bank details are available on the online booking system.  If you are planning to pay by credit or debit card, you must inform us 12 weeks prior to the start date of your holiday.   If BACs or cheque payments are not received 10 weeks prior to departure, and credit / debit card payments made 4 weeks prior to departure, Morzine Holidays reserves the right to cancel your holiday and levy cancellation charges as detailed below.  For bookings made within 12 weeks of departure, payment of the holiday and any additional services must be made in full to confirm your reservation.

 

Breakages Deposit (self catered bookings only)

A refundable deposit of £300 against damages and breakages is required for each chalet, as detailed below.  Deposits will be refunded 2 weeks after the departure date provided all the terms and conditions have been adhered to.   

The chalets will be cleaned prior to your arrival and you are required to leave it clean.  If you do not leave the chalet in a clean and tidy state, the cost of cleaning will be deducted from your deposit.  Under no circumstances are any fixtures and fittings to be removed from the chalets.  The chalets will be checked by our Resort Manager shortly after your departure.  Where the manager advises us that an additional charge will be incurred for cleaning or to cover breakages or missing items, the client will be invoiced and undertakes to pay the sum invoiced in full and within 14 days should the amount exceed the deposit sum held.

 

Amendments By You

Any amendments to the holiday booking that you want to make must be confirmed in writing by post or by email.  The amendments will come into effect on the day they are received.  Morzine Holidays will contact you to discuss the amendments and any subsequent charges that may be incurred as a result of the proposed amendment.  You hereby agree to indemnify Morzine Holidays for any reasonable expenses incurred in making an amendment.

 

Alterations by Morzine Holidays

In the unlikely event that any alteration is made by Morzine Holidays, which is deemed to be significant, i.e alteration to departure, amendments to the booking or cancellation, you will have the right to cancel the holiday.  Should you cancel in such circumstances you will receive a full refund.  In all significant cases Morzine Holidays will pay you compensation as detailed below:

Please note that Morzine Holidays cannot pay expenses, costs or losses incurred by you as a result of any change or cancellation and shall not be liable for any refund should Morzine Holidays be forced to cancel or change your holiday due to circumstances amounting to Force Majeure.  Such circumstances shall include, but are not limited to, war or threat of war, riot, civil strife, terrorism, industrial disruption, natural disasters (such as avalanches), epidemics or health risks, fire, technical problems, adverse weather, nuclear activity, governmental action and similar events beyond our control.

 

Cancellation By You

Should you cancel your holiday for whatever reason charges will be levied as detailed below.  Cancellations will come into effect on the day written notice is received by Morzine Holidays and will be refunded as shown.

If no written notice of cancellation is received and you do not travel, cancellation is deemed to have been received on the day of departure.  Morzine Holidays reserves the right to re-sell any part of a cancelled holiday and this does not affect our right to levy cancellation fees. Depending on the reason for your cancellation, you may be able to reclaim these charges under the terms of your insurance policy.

 

Your Responsibilities

As part of this contract you hereby agree to guarantee payment for any chargeable services requested by any member of your group both before and during your holiday.  

 

It is your responsibility to ensure that each member of your group carries adequate winter sports insurance.  

 

Please treat the chalets and all Morzine Holidays property with care and respect. Morzine Holidays reserves the right to recover from you the cost of breakages, damage to accommodation etc caused with or without intent by you or any member of your party.  If you have caused any damage to the property you will be invoiced for the cost of replacement or repair.  If you have any outstanding payments such as telephone bills, ski passes, ski equipment or ski lessons, you will be invoiced accordingly. All guests undertake to behave in such a manner as in no way to cause, distress, danger or annoyance to other guests, Morzine Holidays employees and/or any third party. Behaviour deemed unacceptable by Morzine Holidays will result in termination of your holiday and you shall have no right to a refund for your holiday or any expenses incurred as a result of termination.  Morzine Holidays does not accept liability for financial loss or damage to property suffered by you other than due to the negligence of Morzine Holiday’s employees. Morzine Holidays accepts no responsibility for the action of its guests and shall not be held liable for any claim made against them (or as a result of their actions) by a third party.

 

The Jacuzzi, Sauna and Games Room 

Guests using the hot tub and games room in Chalets Morin do so at their own risk and Morzine Holidays can accept no responsibility for accidents/injuries sustained while using these facilities. Children must be supervised at all times.

 

Health, Passports & Visas

It is your responsibility to ensure that documents are in proper order before travel. Morzine Holidays accepts no liability for any loss or inconvenience caused as a result of your failure to take reasonable care in this respect. EU Nationals are advised to hold a full passport valid for the duration of the holiday and for at least six months after your return journey.  Vaccinations are not currently required to enter Switzerland or France. Pregnant mothers are advised to obtain clearance to fly both from their doctor and airline if their pregnancy will exceed 28 weeks on the date of their return travel.  Non-EU Nationals are advised to contact the relevant consulate for further information: France: 0207 838 2000. Transport

Where Morzine Holidays is arranging airport transfers on your behalf, it is your responsibility to organise your own group’s air travel and you must inform Morzine Holidays of your arrangements at least 4 weeks before departure giving flight details and arrival times for each guest requiring airport transfers from Geneva airport.  Morzine Holidays cannot accept responsibility for guests missing flights for any reason or mislaying or destroying travel documents and no credit or refund will be given if you fail to take up a component of your holiday as a result.  Morzine Holidays is not responsible for any flight delays but, wherever possible, will provide any previously booked airport - resort transfers.  However, any additional costs incurred as a result of a flight delay will be paid by you.

 

Problems

If you are ever unhappy with any aspect of your holiday, you must address your complaint immediately to both head office on 07832 332066 and the resort manager.  In the unlikely event that your problem cannot be resolved locally, you must inform Morzine Holidays in writing of your complaint within 30 days of your return so that any rights to compensation can be examined.  In the event that your dispute cannot be settled amicably, it may (if you wish) be referred to arbitration under an inexpensive scheme devised and administered by the Chartered Institute of Arbitrators.  Full details are available on request. 

 

Prices  

We reserve the right to change the price of unsold holidays at any time.  Please check the applicable price of your chosen holiday at the time of booking.

These booking conditions and any matters arising from them are subject to and governed by English law. To the best of our knowledge all details on this site were accurate in September 2006.
